WHAT IS AN IMMIGRATION WAIVER

A waiver is a formal request asking the U.S. government to overlook a ground of inadmissibility or deportability that would otherwise bar someone from receiving an immigration benefit. Determining whether a waiver exists — and whether you are eligible — requires careful legal analysis.

COMMON WAIVERS WE HANDLE

  • I-601 Waiver for individuals inadmissible due to prior unlawful presence, certain crimes, or other grounds, where a qualifying U.S. citizen or permanent resident relative would suffer extreme hardship
  • I-601A Provisional Unlawful Presence Waiver, which allows certain individuals to apply before departing for consular processing, reducing time separated from family
  • I-212 Waiver for individuals who have been removed and are seeking permission to reapply for admission

THE EXTREME HARDSHIP STANDARD
